Should Be Hitting 218

1. Assumption Of Risk

I understand that participation in baseball, softball, hitting, pitching, throwing, catching, strength or athletic training, and the use of batting cages and training equipment involves inherent and other risks.

These risks may include, but are not limited to:

• Being struck by a thrown, pitched, deflected, or batted ball;
• Being struck by a bat or other equipment;
• Injuries involving pitching machines, ball feeders, tees, nets, screens, balls, or other training equipment;
• Muscle strains, sprains, fractures, cuts, bruises, concussions, and other athletic injuries;
• Slipping, tripping, or falling;
• Collisions with another participant, coach, guest, equipment, netting, walls, or other objects;
• Equipment malfunction or misuse;
• Injuries resulting from my own actions or the actions of other participants;
• Risks associated with strenuous physical activity; and
• Other risks ordinarily associated with baseball, softball, athletic training, and use of an indoor training facility.

I understand that participation may result in serious injury, permanent disability, or, in rare circumstances, death.

I knowingly and voluntarily assume the inherent risks associated with participating in activities and using the facilities and equipment provided by SBH 218 LLC.

2. Release And Waiver Of Liability

To the fullest extent permitted by Oregon law, I voluntarily release and agree not to bring claims against SBH 218 LLC, including its owners, members, managers, employees, coaches, contractors, agents, and representatives, for injuries or damages resulting from the ordinary negligence of SBH 218 LLC arising from my participation in baseball, softball, fitness, training activities, or my authorized use of the SBH 218 LLC training facility.

I understand that this release is intended to include claims arising from risks associated with participation in these activities to the extent such claims may lawfully be released under Oregon law.

This agreement does not release claims that cannot legally be waived under Oregon law, including claims arising from gross negligence, reckless conduct, willful or intentional misconduct, or other claims that applicable law prohibits an operator from requiring a participant to release.

I acknowledge that I have had the opportunity to read this agreement before participating and that I am entering into it voluntarily.

3. Facility & Equipment Rules

I agree to follow all posted and communicated SBH 218 LLC rules.

I understand and agree that:

• A Forever Strong gym membership DOES NOT provide permission to hit, throw, pitch, catch, use SBH equipment, or otherwise participate in baseball or softball activities in the SBH 218 LLC cages.
• An SBH 218 LLC membership, rental, lesson, team rental, or other SBH authorization provides access only to the SBH batting cages, SBH training area, and SBH equipment/services included with that authorization. It does not include or authorize use of Forever Strong gym equipment, fitness areas, classes, amenities, or other Forever Strong services. Use of Forever Strong gym equipment or services requires a separate Forever Strong membership or other authorization from Forever Strong.
• A valid SBH 218 LLC membership, rental, lesson, team rental, or other authorized reservation is required to use the cages for hitting, throwing, pitching, catching, or training.
• Forever Strong gym members may stretch or perform authorized gym workouts in the cage area only when permitted and when the cages are not being used by SBH participants.
• I will not enter or use a cage during another person’s reserved time without permission.
• I will not swing a bat outside designated hitting areas.
• I will remain alert for thrown and batted balls at all times.
• I will make sure the area around me is clear before swinging a bat.
• Members must wear helmets in the cage at all times.
• I will not climb, hang from, pull on, or intentionally damage cage netting or equipment.
• Horseplay, reckless behavior, fighting, or intentional misuse of equipment is prohibited.
• Food, gum, tobacco products, vaping, alcohol, and illegal substances are prohibited in the cage area.
• I will follow posted instructions and safety requirements.
• I will immediately stop using equipment that appears damaged, defective, or unsafe and report the issue.
• I will return balls and equipment to their designated locations after use.
• I am responsible for damage caused by my intentional misuse, reckless conduct, or unauthorized use of the facility or equipment.
• SBH 218 LLC may suspend or terminate facility privileges for unsafe behavior, rule violations, unauthorized access, or misuse of the facility.

4. Pitching Machine & Training Equipment Use

I understand that pitching machines and other baseball/softball training equipment can cause serious injury when used incorrectly.

I agree to use pitching machines and other SBH 218 LLC equipment only when authorized and according to posted instructions.

I will not modify, repair, dismantle, or otherwise tamper with any pitching machine, ball feeder, electrical equipment, or other SBH 218 LLC equipment.

Participants must remain clear of machine wheels, feeding mechanisms, moving components, and ball exit areas.

I will make sure that all participants are prepared and aware before balls are fed or pitched.

Minors may use pitching machines only in accordance with SBH 218 LLC rules and any applicable adult-supervision requirements.

5. Membership, Reservation & Access Policy

I understand that access to SBH 218 LLC is limited to the dates, times, services, and privileges included with my membership, rental, lesson, team rental, or reservation.

I agree that:

• Door codes, access credentials, booking information, or other facility access information may not be shared with unauthorized individuals.
• I will not allow another person into the facility for the purpose of bypassing SBH 218 LLC membership, rental, or waiver requirements.
• Every person actively participating must have a completed waiver on file before participating.
• Guests must follow all SBH 218 LLC rules.
• Memberships and reservations may not be transferred or shared unless specifically permitted by SBH 218 LLC.
• I will use only the cage, equipment, and time period included in my reservation or membership.
• Reservations must end at the scheduled time so the next member or group can begin.
• Participants are responsible for leaving the area reasonably clean.
• Balls and other equipment must be returned to their designated locations after use.
• Unauthorized access or sharing of access credentials may result in immediate suspension or termination of facility privileges.

6. Health & Fitness Acknowledgment

I represent that I am physically capable of participating in the activities I choose to perform at SBH 218 LLC.

I understand that I am responsible for determining whether participation is appropriate based on my physical condition and for obtaining medical advice when appropriate.

I agree not to participate when an injury, illness, medical restriction, or other condition makes participation unsafe.

7. Minor Participants

If the participant is under 18 years old, I certify that I am the participant’s parent or legal guardian and have authority to enter into this agreement on the participant’s behalf.

I give permission for the minor participant identified above to participate in authorized baseball, softball, athletic training, lessons, memberships, rentals, team activities, and other activities at SBH 218 LLC.

I acknowledge the risks described in this agreement and, to the fullest extent permitted by Oregon law, agree to the assumption-of-risk and release provisions applicable to the minor participant.

I understand that completion of this waiver does not by itself mean that SBH 218 LLC is providing supervision or childcare for the minor.

8. Emergency Care

In the event of an emergency, I authorize SBH 218 LLC personnel or representatives to contact emergency medical services when reasonably necessary.

I understand that SBH 218 LLC does not guarantee that an employee, coach, trainer, or other representative will be physically present during every rental, membership session, or period of facility use.

I understand that I remain responsible for medical expenses associated with an injury or emergency treatment except to the extent otherwise required by applicable law.

9. Video Surveillance & Security

I understand and acknowledge that video surveillance cameras may be in use in and around the SBH 218 LLC training area.

Security cameras may be used for purposes including:

• Facility safety and security;
• Theft prevention;
• Protection of SBH 218 LLC property and equipment;
• Investigation of missing, stolen, or damaged equipment;
• Investigation of accidents or safety incidents; and
• Enforcement of facility and access rules.

9. Video Surveillance & Security (continued)

Video footage may be reviewed by SBH 218 LLC when reasonably necessary for these purposes.

When appropriate, footage may be provided to law enforcement, insurance providers, legal representatives, or other appropriate parties in connection with theft, property damage, safety incidents, legal claims, or as otherwise permitted or required by law.

Security camera footage is not intended for promotional or social media use. Promotional photographs and recordings are addressed separately in the Photo & Video Consent section below.

By entering and using the SBH 218 LLC training area, I acknowledge that video surveillance may be in use.

SBH 218 LLC security cameras are intended to record video only and are not intended to record private conversations.

10. Guest Policy

A "guest" is any person who is not a current SBH 218 LLC member.

I agree that I will not bring a guest into the SBH 218 LLC facility.

If I bring in a guest:

• First violation: I will be charged a $50 guest fee.
• Second violation: my membership will be terminated.
